1. Introduction and General Terms

Welcome to Privadia Limited (“Privadia”, “we”, “us”, or “our”). These Terms & Conditions govern your use of the www.privadia.com website and any associated applications, as well as the booking of any vacational accommodation through our services.

By using our website or making a booking (whether directly as a guest or acting as an agent on behalf of a guest), you agree to be bound by these Terms & Conditions. Privadia Limited is registered in England (Company Number: 08132908, VAT: GB 340810631) with our registered office at Charlotte House, Stanier Way, The Wyvern Business Park, Derby, DE21 6BF, United Kingdom.

Our Role: Privadia acts as a services intermediary for vacational accommodation. We hold agreements with property owners to market and facilitate the rental of their properties. When a booking is made through a travel or booking agency, our direct contract is with that agency. The agency is then contractually obliged to impose these terms, conditions, and obligations upon their end client. Privadia does not own or physically manage the properties. Responsibility for the physical properties and related risks rests with the property owner, the booking agent, and the rental client. Privadia accepts no liability for loss, injury, or delay except where caused directly by our own negligence.

2. Website Terms of Use

  • Intellectual Property: All content, photography, branding, and text on our website are the property of Privadia Limited or the respective property owners. Commercial activity, including using property photography or posting to social media for commercial purposes, is strictly prohibited without prior express written permission from Privadia and the property owner.
  • Accuracy: While we strive to ensure all property descriptions and details are accurate, we rely on information provided by property owners and cannot accept liability for minor discrepancies.

3. Booking Process and Payment Terms

To secure a reservation, the lead client or booking agent must return a signed reservation contract and submit the required payments via bank transfer within 48 hours. Failure to make payment within this timeframe may result in the booking being cancelled.

  • Standard Payment Schedule: A 50% non-refundable deposit is required at the time of booking to confirm the reservation. The remaining 50% balance is due no later than 60 days prior to the arrival date.
  • Late Bookings: If a reservation is made within 60 days of the check-in date, payment for the full duration of the rental period is required immediately upon booking.
  • Late Payments: If payments are not received by the specified due dates, Privadia and the property owner reserve the right to cancel the booking, and any payments made to date may be retained to cover incurred losses.

4. Cancellations and Modifications

Any request to modify or cancel a booking must be made in writing.

  • Client Cancellations: Generally, no refunds of amounts already paid will be given in the event of a cancellation, and any outstanding rental balances remain strictly due. However, if Privadia is able to successfully secure an alternative booking for the exact cancelled dates, a refund of amounts paid may be considered at our discretion. This is not guaranteed, and any refund issued may not be for the full amount paid, as it may be subject to administrative deductions or differences in the new booking rate.
  • Early Departures: If a client chooses to shorten their stay or depart earlier than the agreed check-out date, no refunds will be provided for unused days.
  • Cancellations by Privadia/Owner: In the unlikely event we must alter or cancel a booking, we will endeavour to arrange alternative accommodation of a similar style and standard. If this is not possible, a refund of the property rental value will be issued.

5. Security & Damage Deposit

  • Payment: A refundable damage/security deposit must be paid by bank transfer no later than 14 days prior to arrival.
  • Refunds: The deposit will be refunded within 72 hours of departure, provided the properties are left in the same condition as arrival and there are no breakages.
  • Damages: If damage occurs, it must be reported immediately with photographic evidence. If the cost of damages exceeds the deposit, the client agrees to pay the additional balance within one (1) business day of receiving an invoice. Any deductions made from the deposit will incur an administration fee of €50 plus applicable taxes. In the case of lost keys/fobs, costs for lock changes and admin fees will be deducted.

6. Property Rules and Occupancy

  • Arrival and Departure: Standard check-in is from 16:00, and check-out is strictly by 10:00. Check-ins later than 20:00 (8:00 PM) local time or earlier than 09:00 (9:00 AM) local time will be subject to an additional late/early check-in fee so we can arrange for a representative to meet the client at the property.
  • Late Check-outs: Late checkouts can be requested and will be decided by the owner and will depend on the availability of the property and the arrival of the next guests. Unauthorised late check-outs will incur a charge of a full day’s rental fee, as this will severely impact the ability to prepare the property for the next guests.
  • Occupancy Limits: The number of guests occupying the property must not exceed the exact number of people stated on your rental contract. Even if the property has a higher maximum capacity, arriving with more guests than officially booked is strictly forbidden. Non-compliance will result in immediate eviction or a supplementary occupancy charge.
  • Parties, Events, and Noise: General parties are strictly prohibited. However, specific events (such as birthday parties, weddings, or larger gatherings) may be allowed strictly at the property owner’s discretion and may incur an additional event fee. Regardless of any event approval, local noise laws strictly apply: music and noise must be kept below 45 decibels between 22:00 and 09:00. External sound systems are forbidden unless prior written approval is granted. Breach of these terms will result in immediate eviction and loss of the security deposit.
  • Smoking: Smoking (including e-cigarettes) is strictly prohibited inside the properties. Any evidence of indoor smoking will result in additional cleaning charges deducted from the deposit.
  • Pets: Pets are not permitted without express written authorization. Unauthorised pets will lead to eviction and loss of all monies paid.

7. Insurance and Liability

  • Insurance: The rental price does not include personal travel insurance. It is the client’s sole responsibility to obtain comprehensive travel insurance covering cancellations, personal liability, medical expenses, and property damage. Privadia bears no responsibility for uninsured losses.
  • Force Majeure: Privadia and the property owners are not liable for any failure to perform obligations due to events beyond reasonable control, including natural disasters, government restrictions, strikes, or pandemics.
  • Liability: Privadia accepts no liability for loss, theft, injury, or death at the properties, except where caused directly by our own negligence.

8. Complaints Procedure

  • During the Stay: If an issue arises, the client must contact Privadia’s Guest Experience team immediately. Claims for compensation raised post-departure, without prior notification to Privadia during the stay to allow us to rectify the issue, will generally not be considered.
  • Pre-Travel: If booked through an agent, any pre-travel complaints should be directed to the booking agent via their appropriate communication channels.

9. Governing Law and Dispute Resolution

In the event of a dispute, parties agree to attempt resolution through mediation or arbitration before initiating legal proceedings. This contract, and any disputes arising between the client, agent, and Privadia, shall be subject to the laws and the jurisdiction of the Courts of the country where the rental properties are located.
